TERMS & CONDITIONS OF SALE
These Terms & Conditions govern all bidding, purchases, and transactions conducted by Powers Equipment Auctions Inc. through its online auction platform and affiliated services.
By registering to bid, placing a bid, or participating in any auction, bidder acknowledges that they have read, understood, and agreed to all Terms & Conditions contained herein.

Powers Equipment Auctions Inc. acts as auctioneer and agent for various consignors and sellers.
2. BIDDER REGISTRATION
All bidders must register prior to bidding and provide accurate contact and payment information.
By registering, bidder certifies that:
They are at least 18 years of age;
They are legally authorized to enter binding contracts;
All information provided is accurate and complete.
Powers Equipment Auctions Inc. reserves the right to deny, suspend, or revoke bidding privileges at its sole discretion.
The auction company may require identity verification, proof of funds, bank letters, or additional documentation prior to approving or releasing purchases.
3. CREDIT CARD AUTHORIZATION
By registering to bid, bidder authorizes Powers Equipment Auctions Inc. to charge the credit card on file for:
Purchases and invoices under the approved $2,500 credit card payment limit;
Buyer’s premiums;
Sales tax;
Administrative fees;
Storage fees;
Unpaid balances;
Chargeback recovery costs;
Collection costs;
Any other amounts owed under these Terms & Conditions.
Credit cards may be pre-authorized or verified prior to bidding.
Powers Equipment Auctions Inc. reserves the right to decline credit card payments, require ACH or wire transfer, or request additional verification for any purchase at its sole discretion.
Declined credit cards may result in suspension or termination of bidding privileges.
4. PAYMENT TERMS
All payments must be made in U.S. Dollars (USD).
Payment is due within 48 hours of auction close unless otherwise stated by Powers Equipment Auctions Inc.
Accepted payment methods may include:
ACH transfer;
Wire transfer;
Cash;
Certified funds or cashier’s check approved by the auction company;
Credit or debit card for qualifying invoices.
A 4% convenience fee will be added to all credit and debit card transactions.
Credit and debit card payments will not be accepted for invoices exceeding $2,500 unless specifically approved by Powers Equipment Auctions Inc.
Invoices exceeding $2,500 must be paid by ACH transfer, wire transfer, certified funds, cash, or other approved payment methods.
ACH payments, wire transfers, international payments, and other electronic payment methods may be subject to administrative and processing fees. Applicable fees will be disclosed on the buyer’s invoice.
Current processing fees are as follows:
ACH Payments: $25
Domestic Wire Transfers: $25
International Wire Transfers: $45
Powers Equipment Auctions Inc. reserves the right to modify processing fees at any time.
Equipment, vehicles, and purchased items will not be released until payment has been received in full and verified by the auction company and/or financial institution.
Proof of payment does not guarantee immediate release of equipment or merchandise.
Paid receipts and final settlement confirmations may be issued only after funds have fully cleared applicable financial institutions.
Buyers agree not to place stop payments or otherwise reverse valid payments related to auction purchases.
Returned checks, failed ACH payments, reversed payments, declined transactions, or payment disputes are subject to additional fees, collection costs, and administrative charges.
Unpaid invoices may result in:
Cancellation of sale;
Resale of items;
Suspension of bidding privileges;
Collection activity;
Legal action;
Recovery of attorney fees and related costs.
5. BUYER’S PREMIUM
A 2.5% buyer’s premium will be added to all purchases unless otherwise stated in the auction listing.
Applicable processing or convenience fees may also apply where permitted by law.
6. SALES TAX
Wisconsin sales tax will be collected where applicable unless a valid exemption certificate is provided prior to payment.
Buyer’s premiums, administrative fees, and other applicable charges may also be subject to sales tax in accordance with Wisconsin law.
It is the bidder’s responsibility to provide all required exemption documentation before invoicing is finalized.
Failure to provide proper documentation may result in sales tax being charged.
Out-of-state buyers remain responsible for complying with all applicable tax laws in their jurisdiction.
7. AS-IS, WHERE-IS TERMS
ALL ITEMS ARE SOLD “AS-IS, WHERE-IS,” WITH ALL FAULTS AND WITHOUT WARRANTIES OR GUARANTEES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.
No warranty is made regarding:
Condition;
Functionality;
Merchantability;
Fitness for a particular purpose;
Hours;
Mileage;
Age;
Authenticity;
Title status;
Operability;
Safety;
Emissions compliance;
Accuracy of descriptions.
Descriptions, photographs, videos, hours, measurements, and other information are believed to be accurate but are not guaranteed.
Quantities, counts, measurements, dimensions, descriptions, and other listing information are approximate and not guaranteed unless expressly stated otherwise.
Bidders are solely responsible for inspecting items and determining condition prior to bidding.
No refunds, returns, adjustments, or chargebacks will be permitted.
ALL SALES ARE FINAL.
8. INSPECTION
Bidders are strongly encouraged to inspect all items prior to bidding.
Failure to inspect does not relieve bidder of responsibility for payment or compliance with these Terms & Conditions.
Inspection dates and times will be announced for each auction where applicable.
9. ONLINE BIDDING DISCLAIMER
Powers Equipment Auctions Inc. is not responsible for:
Missed bids;
Delayed bids;
Internet interruptions;
Platform outages;
Software malfunctions;
Mobile app failures;
Connectivity issues;
Technical errors of any kind.
The auction company reserves the right to pause, extend, reschedule, reopen, or cancel bidding in the event of technical issues or disputes.
10. EXTENDED BIDDING / SOFT CLOSE
Lots may feature automatic bid extensions.
If a bid is placed within the final minutes of a lot closing, bidding may automatically extend for an additional 2 minute period as determined by the auction company.
The auction company reserves the right to modify closing times, extension periods, lot order, or auction format at any time.
11. AUCTION COMPANY RIGHTS
Powers Equipment Auctions Inc. reserves the right to:
Reject or revoke bids;
Remove bidders;
Reopen bidding;
Cancel lots;
Withdraw items;
Group or divide lots;
Resolve bidding disputes;
Refuse service;
Correct catalog errors;
Modify auction terms;
Restart or extend auctions.
The auction company’s decisions shall be final.
12. CONSIGNMENT & OWNERSHIP DISCLOSURE
Powers Equipment Auctions Inc. acts solely as agent for consignors and sellers.
The auction company does not guarantee:
Ownership history;
Lien status;
Prior repairs;
Service history;
Title status;
Mileage accuracy;
Hours accuracy;
Absence of defects.
Certain items may be sold subject to owner confirmation or reserve unless otherwise stated.
13. TITLE & VEHICLE TERMS
Titles, where applicable, will be transferred only after full payment has been received and verified.
A $25 title processing fee may apply to applicable titled vehicle, trailer, and equipment purchases.
Certain titles may be delayed due to lender releases, DMV processing, consignor paperwork, title reassignment requirements, or other administrative matters.
Powers Equipment Auctions Inc. is not a licensed motor vehicle dealer and does not issue temporary plates, temporary registrations, or temporary operating permits.
Buyers are solely responsible for:
Registration;
Titling;
Licensing;
Insurance;
Transportation;
Compliance with all local, state, and federal laws.
Buyers are responsible for ensuring all vehicles, trailers, and titled equipment are legally transported and operated in accordance with applicable laws prior to removal from auction premises.
Powers Equipment Auctions Inc. does not guarantee processing timelines for title delivery once paperwork has been submitted to applicable agencies or third parties.
14. REMOVAL & PICKUP
All items must be removed within fourteen (14) calendar days of auction close unless prior written arrangements have been approved by Powers Equipment Auctions Inc.
Buyers are responsible for:
Loading;
Rigging;
Transportation;
Labor;
Insurance;
Equipment needed for removal.
Buyers and their agents enter auction premises at their own risk.
The auction company may assist with loading as a courtesy only and assumes no liability for damages, accidents, injuries, or delays.
Items not removed within the stated removal period may incur:
Storage fees;
Relocation fees;
Administrative fees;
Abandonment penalties;
Resale without refund.
If purchased items are not removed within fourteen (14) calendar days of auction close, Powers Equipment Auctions Inc. reserves the right, without further notice, to:
Repossess the item(s);
Reconsign and resell the item(s);
Recover all storage, administrative, transportation, resale, and related costs.
Any remaining balance after deduction of commissions, buyer’s premiums, storage fees, administrative fees, resale costs, transportation costs, and other applicable charges may be issued to the original purchaser in the form of a consignor settlement at the auction company’s discretion.
Failure to remove purchased items may also result in suspension or termination of future bidding privileges.
15. RISK OF LOSS
Risk of loss transfers to the buyer immediately upon:
Auction close; or
Declaration of sold status.
Buyer assumes all responsibility thereafter.
16. DEFAULT & NON-PAYMENT
Failure to comply with these Terms & Conditions constitutes default.
In the event of default, Powers Equipment Auctions Inc. may:
Cancel the sale;
Retain deposits;
Resell items;
Recover deficiencies;
Pursue legal action;
Report non-payment to industry platforms;
Suspend future bidding privileges.
Defaulting bidders shall be responsible for all resulting damages, collection costs, attorney fees, and administrative expenses.
17. CHARGEBACK WAIVER
By registering and bidding, bidder expressly agrees not to initiate credit card chargebacks for valid auction purchases.
Bidder acknowledges that:
Bids are legally binding;
Auction purchases are final;
Descriptions are informational only;
All items are sold AS-IS.
Improper chargebacks may result in legal action and recovery of all related costs and fees.
18. LIMITATION OF LIABILITY
Powers Equipment Auctions Inc., its owners, employees, agents, consignors, affiliates, and representatives shall not be liable for:
Personal injury;
Property damage;
Financial losses;
Mechanical failures;
Missed profits;
Transportation delays;
Data loss;
Technical failures;
Acts of God;
Any indirect or consequential damages.
Participation in auctions and presence on auction premises is entirely at bidder’s own risk.
19. GOVERNING LAW
These Terms & Conditions shall be governed by and interpreted under the laws of the State of Wisconsin.
Any legal disputes shall be resolved exclusively in the courts located in Green County, Wisconsin.
20. ACCEPTANCE OF TERMS
By registering, bidding, purchasing, accessing the auction platform, or participating in any auction conducted by Powers Equipment Auctions Inc., bidder acknowledges acceptance of all Terms & Conditions contained herein.
The auction company reserves the right to amend these Terms & Conditions at any time without prior notice.
